7Fabs Terms of Use

1. Scope and acceptance

These Terms of Use ("Terms") govern your access to the 7Fabs website, customer portal, quote-request tools, and file-upload tools (the "Services"). The Services are operated by 7Fabs LLC ("7Fabs," "we," "us," or "our"), a Florida limited liability company providing design, fabrication, and 3D printing services. You accept these Terms by affirmatively indicating agreement where the Services ask you to (for example, a checkbox at signup, upload, or quote approval). We keep a record of each acceptance, including the version accepted.

2. Website and account use

You may use the Services only for lawful business or personal project purposes. You are responsible for the accuracy of the information you submit and for safeguarding access to your portal account or authenticated session. Notify us promptly at admin@7fabs.com if you suspect unauthorized account use.

3. Quotes and project agreements

Website content and a request for quote are not offers to contract. A project is governed by the specific written quote, order, or other agreement that 7Fabs issues and that the parties accept, together with the Quote Terms & Conditions in effect when the quote is accepted. That agreement controls its scope, price, timing, payment, delivery, cancellation, and technical specifications.

4. Acceptable use

You must not upload or request work involving material that you lack the right to provide, that is unlawful to produce or possess, or that would require 7Fabs to violate applicable law. Without limiting that rule, you must not submit files containing export-controlled technical data (including ITAR-controlled defense articles) without disclosing that status in advance and confirming a lawful basis, and you must not request fabrication of items that are unlawful for you to possess or for 7Fabs to make. You must not interfere with, probe, or disrupt the Services, or misrepresent your identity or authority to act for another person or business. 7Fabs may decline any request in its reasonable discretion.

5. Files

Files submitted through the Services are subject to the separate File Upload / Customer-Supplied File Terms, which include the limited license you grant us to process your files.

6. Not professional engineering services

7Fabs provides design, CAD modeling, prototyping, and fabrication services. 7Fabs does not provide professional engineering services and is not a licensed engineering firm under Chapter 471, Florida Statutes. Work requiring a licensed professional engineer — including sealed drawings, certified structural or safety analysis, or code-compliance certification — must be obtained from a licensed engineer engaged by you.

7. Service availability

We may maintain, modify, suspend, or discontinue a Service when reasonably necessary for operations, security, or legal compliance. The Services are provided on an "as available" basis; this does not alter any warranty or other commitment expressly stated in an accepted project agreement.

8. Disclaimer of warranties

EXCEPT FOR THE EXPRESS COMMITMENTS STATED IN AN ACCEPTED QUOTE OR PROJECT AGREEMENT (INCLUDING THE QUOTE TERMS & CONDITIONS), THE SERVICES AND ALL GOODS AND SERVICES ARE PROVIDED WITHOUT ANY OTHER WARRANTY OF ANY KIND, AND 7FABS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION OBTAINED FROM 7FABS CREATES A WARRANTY NOT EXPRESSLY STATED IN AN ACCEPTED PROJECT AGREEMENT. SOME JURISDICTIONS LIMIT WARRANTY DISCLAIMERS; THIS SECTION APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, 7FABS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SERVICES OR ANY PROJECT, AND 7FABS'S TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID 7FABS FOR THE PROJECT OR ORDER GIVING RISE TO THE CLAIM (OR, FOR CLAIMS NOT TIED TO A PROJECT, ONE HUNDRED U.S. DOLLARS). THIS SECTION DOES NOT LIMIT LIABILITY FOR PERSONAL INJURY CAUSED BY GOODS SOLD FOR CONSUMER USE, FOR FRAUD OR WILLFUL MISCONDUCT, OR FOR ANY LIABILITY THAT CANNOT LAWFULLY BE LIMITED. THE REMEDY LIMITATIONS IN THE QUOTE TERMS & CONDITIONS APPLY TO NONCONFORMING WORK.

10. Indemnification

You will defend and indemnify 7Fabs against third-party claims, damages, and reasonable costs (including attorney's fees) to the extent arising from: (a) files, designs, or instructions you supply, including claims of intellectual property infringement; (b) your breach of these Terms or of the representations in the File Upload Terms; or (c) your unlawful use of an item 7Fabs fabricated to your specifications. This Section does not require you to indemnify 7Fabs for 7Fabs's own negligence or misconduct.

11. Electronic records and signatures

You consent to transact electronically. Your electronic acceptance (checkbox, portal approval, or e-signature) has the same effect as a handwritten signature, and our records of acceptance (including document version and hash) are valid records of the agreement.

12. Governing law and venue

These Terms are governed by Florida law, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in the state or federal courts located in Orange County, Florida, and you consent to personal jurisdiction there.

13. General

If a provision of these Terms is held unenforceable, the remainder stays in effect, and the provision will be enforced to the maximum lawful extent. These Terms plus the documents they incorporate are the entire agreement about the Services; a specific accepted project agreement controls its project. You may not assign these Terms without our written consent; we may assign to a successor of the business. A failure to enforce a provision is not a waiver. Neither party is liable for delay caused by events beyond its reasonable control, except payment obligations.

14. Changes and contact

We will publish a new controlled version before material changes take effect; material changes apply to you when you next accept or, where acceptance is not requested, upon posted notice. Questions: admin@7fabs.com.
